Trafficking (simpliciter) Any person who trafficks or attempts to traffick a traffickable amount of a drug of dependence is liable to a maximum sentence of 15 years. This offence can be heard summarily the Magistrates’ Court, which attracts the lower sentencing jurisdiction. How is actus reus determined? WebbMy understanding is that the simpliciter offence has not been added, either upon original enactment or when the act was amended, primarily because at the time there was less evidence to show that persons who engaged in simpliciter offences were at risk of reoffending to commit a sexual offence against a person.
